General terms and conditions of sale

Article 1: Preliminary provisions

These general terms and conditions of sale (hereinafter the "GTC") apply in their entirety as of January 1, 2022, to all activities and services organized at Parc Oméga (hereinafter the "Services") and sold to individual customers (hereinafter the Customer(s)) by Parc Omega INC. (hereinafter the "Seller").

The GTC govern any sale of services made by telephone through the contact center, at the Parc Oméga ticket office, at the Seller's accommodation reception desk, or online on the Parc Oméga website parcomega.net (the "website").

The Seller offers Customers (i) hotel services in the form of stays or overnight accommodations, (ii) wildlife park visit services in the form of ticketing (electronic ticket, annual pass, gift certificate, combined ticket), and (iii) any other ancillary service (dining, etc.).

Within the scope of the GTC: a "stay" refers to a tourist package consisting of at least one overnight stay in one of the Seller's accommodations, breakfast, and a visit to Parc Oméga; "accommodation" refers to an overnight stay only in one of the Seller's accommodations; "ticketing" or "ticket" refers to an access pass, day ticket, package, or subscription allowing the customer to access Parc Oméga's recreational areas on a specific date or during a specified period; any purchase of one of the aforementioned services implies the customer's unreserved acceptance of the GTC, notwithstanding any contrary stipulation.

Article 2: Seller identification

The services covered by these terms are organized and sold to customers by: Parc Omega INC.

Article 3: Ordering services

The purchase of services (hereinafter the "order") may be made:

  • At the Seller's ticket office, 399 Route 323 Nord, Montebello, Québec J0V 1L0, on Parc Omega's days of operation, and at the accommodation reception desk;
  • By telephone through the contact center, reachable at: 819 423-5487 (non-premium call – cost of a local call);
  • Online on the website accessible at the following address: parcomega.net.

Article 3.1: Pre-contractual information

It is specified that the information appearing on the website and booking summary, supplemented by these GTC, constitutes the prior information. Consequently, the customer acknowledges having received, prior to confirmation of the booking and conclusion of the contract, in a clear and understandable manner, the pre-contractual information and in particular the following information:

  • The destination, essential characteristics, and tourist category of the accommodation;
  • The total price of the trip and payment terms;
  • Cancellation conditions;
  • Services and meals included in the price of the activity;

For any purchase of services other than stays, the customer acknowledges having received, prior to confirmation of the booking and conclusion of the contract, in a clear and understandable manner, the pre-contractual information and in particular the following information:

  • The description and essential characteristics of the service;
  • The price and date of performance.

Article 3.2: Telephone orders

For any telephone order, the customer must specify, in addition to the mandatory information listed above, the delivery address (postal or email) and the name of the beneficiary.

After communicating to the customer the pre-contractual information listed in Article 3.1 of these GTC, the Seller invites the customer to review these GTC. Once agreement is reached on the fulfillment of the order under the communicated conditions, the customer proceeds with remote payment according to the terms provided in Article 5.

Article 3.3: Online orders

For any online order, the customer is invited to provide their email address and, where applicable, to register using a personal customer account creation form. The customer has the ability to review the details of their order and its total price, and where applicable to correct errors before confirming it, thereby expressing their acceptance. To finalize the order, the customer must read the GTC, accept them by checking the boxes provided for this purpose, and proceed with payment.

Article 3.4: Order confirmation

The order is firm and final only when the full price has been collected by the Seller. The sales contract is then deemed formed. For any remote or online order of services, the customer receives, by email, an order confirmation summarizing the purchases made, the price applied, and the essential characteristics of the services ordered. For any ticket order, the confirmation email includes:

  • Proof of payment;
  • The dematerialized access pass(es).

For any stay or accommodation order, the confirmation email includes:

  • Proof of payment;
  • The description of the services ordered.

The order confirmation email received by the customer serves as proof of the entirety of the transaction and constitutes the sole authoritative document in the event of a dispute.

Article 4: Service prices

Our product prices are indicated in Canadian dollars, and applicable taxes are added. All orders, regardless of their origin, are payable in Canadian dollars. The Seller reserves the right to modify its prices at any time. Products are always billed based on the rates in effect at the time the order is recorded.

The Seller reserves the right to reduce its rates and apply discounts at any time, without being obligated to refund customers who purchased tickets at the regular price.

The Seller reserves the right, without further prior notice, to refuse to do business with a customer or to set a quantity limit for any item in an order. At any time, it may be necessary for the Seller to verify personal information or credit card details before accepting any order.

The Seller is subject to applicable sales taxes in Canada. The taxes added will be QST (Quebec Sales Tax) and GST (Goods and Services Tax).

Article 5: Payment terms and methods

For any order of services, the full price must be paid in one installment and in Canadian dollars at the time the order is placed. Payment may be made by bank card, Mastercard, or Visa. The fees offered must be paid according to the payment procedure described during the registration process. The Customer agrees to pay the total cost and related charges for the product purchased, including taxes. The Seller may modify the price after having notified the customer. The customer is solely responsible for the actual payment of the product purchased. Only the user is responsible for bank card payment for the service offered. The Seller is not responsible for payment problems related to the operation of the e-commerce service.

Electronic payments made for telephone or online orders on the Seller's website are secured through the use of encryption procedures guaranteeing the confidentiality and security of data.

Article 6: Ticket delivery and terms

For any remote order, access passes are sent to the customer by email immediately after payment of the order.

Day tickets

Non-refundable product. The customer confirms having read and understood the safety instructions and all other special measures implemented by the Seller (see Articles 9 and 11).

Oniro tickets or night event

Non-refundable and non-modifiable product (date and time).

Good weather or bad weather, the event takes place. In case of adverse weather conditions (tornado or severe storms), the Seller may delay departures or cancel the activity to ensure everyone's safety. In case of cancellation, the information will be posted on the day itself from 3 p.m. on parcomega.net, as well as on the Parc's parcomega.net. For any cancellation made by the Seller, ticket holders may select a new date and time slot.

Reservation required for toddlers (ages 2–5). Children aged 12 and under must be accompanied by an adult at all times. It is strictly forbidden to consume drugs and alcohol during this activity.

By purchasing a ticket, the customer acknowledges that they walk the trail at their own risk. The route is not recommended for persons with reduced mobility, as it includes ascending and descending slopes of approximately 35 degrees. By purchasing a ticket, the customer acknowledges being able to undertake the activity with full knowledge of the facts and accepting the risks that this activity may entail. The customer agrees to comply with all safety rules and other rules imposed by the Seller.

Gift certificate

This product is non-refundable and non-redeemable for cash. Resale is strictly forbidden and illegal. The gift card amount may be used for the purchase of admission, dining, and at the various points of sale at Parc Oméga. This gift certificate is not valid for online booking and payment. It is not replaceable or refundable in case of loss, theft, or damage.

Annual pass

This product is non-refundable and non-exchangeable.

The pass issued by the Seller allows holders to access the wildlife park at all times during the applicable opening hours (opening hours vary by season).

The pass is valid for a period of one year. The period covered by the pass begins on the date of purchase. Once the purchase is made, the individual must visit Parc Oméga to have their photo taken and collect their card before their first visit.

The pass may only be used by its holder and may under no circumstances be sold, transferred, or exchanged.

The holder's photo must appear on the pass card.

Pass holders under the age of 16 must be accompanied by an adult to access the park.

To benefit from access to the park, the holder must present their pass card at admission. Photo identification may be requested from the pass holder at any time.

In case of damage or loss of a card, a new card may be requested from the administrative office for a fee of $5.

The Seller reserves the right to temporarily close the park or certain sections of the park due to extreme weather conditions or any other exceptional condition.

The Seller reserves the right to close certain parts of the park without prior notice.

A pass card may at any time be revoked by the Seller if the customer's behavior does not comply with safety instructions on the Parc Oméga site. No refund or compensation will be granted in such a situation.

Article 7: Ticket control

A dated ticket is valid only for the date(s) it specifies. An undated ticket does not guarantee access to the park in case of high attendance. Ticket control is performed at the entrance to Parc Oméga using barcode readers or QR codes. In this context, the Seller reserves the right to also verify the identity of customers holding tickets.

The dematerialized ticket (e-ticket) is valid only if printed on blank white paper, front and back, or displayed on a mobile phone screen (smartphone).

The customer remains solely responsible for the use made of their ticket(s). A ticket (thermal or dematerialized) that is damaged, has an unreadable barcode, or has already been scanned is considered invalid.

Article 8: Product description
The Seller and its affiliated companies do everything in their power to ensure the greatest accuracy on the website. However, the Seller does not guarantee that the description of products or any other content on the parcomega.net website is accurate, complete, reliable, up to date, or free of error. If a product offered by the Seller does not conform to its description, your sole remedy is to contact the Seller.

Article 9: General safety rules

The customer confirms having read and understood the safety instructions and all other special measures in place. To visit the park, it is mandatory to have a vehicle (car, bus, recreational vehicle). It is forbidden to travel by motorcycle on the site. Pets are strictly forbidden in the park and in Parc Oméga's accommodations. It is forbidden to exit the vehicle. All vehicle doors must be closed (rear hatch and sliding doors). During the car route, windows must be half open to prevent animals from putting their heads inside the customer's vehicle. It is forbidden to feed the bison. During the breeding season (September to mid-November), avoid approaching male deer. It is strictly forbidden to feed them. You travel at your own risk and in case of non-compliance with these general safety rules, the Seller's liability cannot be engaged and the Seller reserves the right to exclude, without any refund being possible, customers who do not comply with these general safety rules.

Article 10: Recommendations

  • Bring photo identification and the credit card used to purchase the ticket when visiting.
  • Protect your ticket like any other valuable item.
  • Never purchase an electronic ticket from a stranger. It may be an unauthorized copy. The electronic ticket has no resale value.

Article 11: Liability

The holder of an electronic ticket assumes all responsibility for risks and dangers that may arise from the activity, whether suffered before, during, or after it, and waives any claim for loss and damage resulting from any cause whatsoever. The Seller cannot be held responsible for problems or direct or indirect damage that may occur during the event.

The electronic ticket, annual pass, or gift certificate constitutes a contract between the customer and the Seller. The purchaser agrees to pay the amount indicated on the receipt, including service fees where applicable. The amount billed will appear on the next account statement under the name PARC OMÉGA INC. No refund or exchange will be granted unless the event is cancelled by the Seller. In such a case, the purchaser must contact the event promoter or the administration of PARC OMÉGA INC. at (819) 423-5487.

Article 12: Exceptional and unavoidable circumstances

Exceptional and unavoidable circumstances refer to any situation beyond the control of the customer, the Seller, and any service provider involved in fulfilling the order, the consequences of which could not have been avoided even if all reasonable measures had been taken, and which prevent the performance of all or part of the obligations provided for in the contract.

This will apply in particular in cases of: force majeure, climatic, geographic, health, or political conditions in the immediate vicinity of the destination that may endanger the customer's life. In the event of exceptional and unavoidable circumstances, the option to terminate the contract without charge is available to both the Seller and the customer. It is specified that the assessment of the occurrence of these circumstances will rest solely on objective elements.
